General Terms and Conditions
These General Terms and Conditions constitute a contract, provided no other contract exists. They apply to any services related to ensa, a programme of the Swiss Foundation Pro Mente Sana, Zurich.

Scope / General
ensa, a programme of the Pro Mente Sana Foundation, is supported by the Beisheim Foundation.
A course takes place at the advertised location and times. It includes the teaching materials, examination and certificate and/or ID card. The course organizer is the Swiss Foundation Pro Mente Sana.
Conclusion of the contract
ensa first aid courses can be obtained from www.ensa.swiss. Fees will be charged. Registration for a course is conditional on the acceptance of the present General Terms and Conditions. Thus registering for a course obliges you to pay the course fee.
Courses are open solely to competent persons resident in Switzerland or the Principality of Liechtenstein.
Prices and payment
Applicable course prices are those set out at www.ensa.swiss at the time of registration. All prices are expressed in Swiss francs. Participants can pay for courses using the payment methods set out at www.ensa.swiss.
Only one voucher can be used per order. They cannot be cumulated.
Data protection
We process the information relating to you that we need for course registration with the greatest care and in accordance with Swiss data protection. No use of it is made outside Pro Mente Sana.
We do not sell your data to other institutions or companies.
Course places and course implementation
The course places are allocated in the order in which registrations are received, subject to timely payment.
It can happen that a course cannot take place despite confirmation due to lack of sufficient participants. In this case all registered persons will be informed. Participants can then rebook for another course free of charge via a rebooking link. If no replacement course can be attended, payment will be refunded in full to the course participant.
Course cancellation, rebooking, catching up of course parts and fee reimbursement
Every registration for an ensa course is binding. Cancellations can be sent to info@ensa.swiss.
Cancellation:
In case of cancellation of participation in a public course, the course fees will be refunded deducting a cancellation fee of CHF 50 (incl. VAT). Once a course has started, cancellation is no longer possible and course fees will not be refunded in case of course cancellation.
Rebooking:
If the user wishes to rebook to another course up to 7 days before the first day of a public course, they can do so using the link in the confirmation email to the original course. There will be no charge. If the rebooking is made less than 7 days before the start of the course, a rebooking fee of CHF 30 (incl. VAT) will be charged. Rebooking after the start of the course is not possible.
Alternatively, cancellation is also possible under the above conditions.
Catch up:
If the user misses one or more course parts, they will receive an email notification. This contains a link that allows the user to book the missed course parts in an alternative course within 6 months. The user will be shown all options available at that time. A catch-up fee of CHF 50 (incl. VAT) is charged per booking. Multiple catch-up dates can be booked. In the case of multiple ensa courses (non-public courses) booked by one organization, it is possible to catch up with another course from the same organization, if there are enough seats available. In this case, the catch-up fee does not apply.
Instructor training:
Special registration and de-registration conditions apply to instructor training courses and will be agreed upon with the registration confirmation.
Video and audio recordings
No video or audio recordings may be made without the express consent of ensa, instructors and course participants. This is subject to Swiss data protection.
Changes to courses and prices
The right to make significant changes to courses and prices is reserved.
Insurance and liability
Accident, health and liability insurance are the responsibility of the participants. We point out that the discussed contents (can) initiate a trigger that can lead to emotional instability. Participation in the course is at your own risk. All participants are responsible for their own physical and/or psychological well-being. Liability is excluded to the extent permitted by law.

If your personal information changes or you have a complaint, please contact info@ensa.swiss.
Appeal
If attempts to find an amicable solution have failed, participants in the first aid courses who have not passed the online examination can appeal against the negative examination decision within 30 days of the decision being made. The appeal must be submitted in writing to the Appeals Commission of Pro Mente Sana, Hardturmstrasse 261, 8005 Zurich. The Appeals Commission consists of members of the Pro Mente Sana legal team and the Pro Mente Sana prevention department. The decision is issued verbally or in writing with reasons. The costs of the proceedings are based on the time and effort involved and are charged to the losing party.
Exclusion from the instructor training programme
In the event of inappropriate behaviour (e.g. negligence, failure to meet deadlines and requirements) or violation of the values of Pro Mente Sana, the Foundation reserves the right to exclude participants from the training. Fees for services already used remain due.
Final provisions and place of jurisdiction
Should any part of these General Terms and Conditions prove for any reason to be unenforceable or invalid, the effectiveness of the remaining provisions shall be unaffected thereby.
Only Swiss law shall apply, to the exclusion of conflict-of-law rules. The place of jurisdiction is the head office of the Swiss Foundation Pro Mente Sana, i.e. Zurich.
